Terms of Use – Tournée facile

1. Introduction

These Terms of Use (hereinafter the “Terms”) govern access to and use of the Tournée facile web and mobile application, published by Hakimon Solutions, a French SAS company with registered offices at 200 rue de la Croix Nivert, 75015 Paris, registered with the Paris Trade and Companies Register under number 992 080 1920 0014 (hereinafter “the Publisher” or “Hakimon Solutions”).

By using Tournée facile, you acknowledge that you have read, understood, and accepted all of these Terms.

2. Purpose of the Terms

The purpose of these Terms is to legally govern access to and use of:

  • the tourneefacile.com website,
  • the Tournée facile mobile application (iOS / Android),
  • and all associated services.

Using any of these services implies full and unconditional acceptance of the Terms.

3. Description of the Services

Tournée facile is an application designed for healthcare professionals (notably home-care nurses), enabling in particular:

  • route planning,
  • route optimization,
  • sharing and reformulation of clinical handovers,
  • patient management,
  • a secure messaging system,
  • a shared calendar,
  • document management (patient documents, photos, etc.),
  • billing modules,
  • and various other professional coordination tools.

Some services may require a Freemium subscription, as described during registration and on the applicable pricing pages.

4. User Account

4.1 Account Creation

Access to Tournée facile’s features requires the creation of a personal account.

When registering, the User must provide:

  • Last name,
  • First name,
  • Email address,
  • Password,
  • Where applicable, professional information (e.g., RPPS number).

The information provided must be accurate, complete, and regularly updated.

4.2 Account Security

The User is responsible for maintaining the confidentiality of their password and the use of their account. Any fraudulent use must be immediately reported to: contact@tourneefacile.com.

5. Access to Services

Access to the services requires an Internet connection. All associated costs (hardware, software, connection fees, etc.) are borne by the User.

The Publisher reserves the right to restrict or suspend access to the service for maintenance or security reasons, without prior notice.

6. Personal Data and GDPR

Tournée facile processes personal data, including certain health data, which are classified as “sensitive data” under the GDPR.

6.1 Categories of Data Collected

  • Identification data (last name, first name, email).
  • Professional data (RPPS number, route information).
  • Geolocation data (only during use).
  • Patient health data (notes, documents, clinical handovers, etc.).
  • Documents and photos shared within the application.

6.2 Purposes

Data are collected solely for the following purposes:

  • ensuring proper service operation,
  • optimizing routes,
  • enabling patient management,
  • ensuring the security and traceability of clinical handovers,
  • enabling billing,
  • improving user experience.

6.3 Legal Basis

The main legal bases are:

  • performance of the usage contract,
  • legitimate interest related to service improvement,
  • consent for sensitive data where required.

6.4 Hosting

All data are hosted in France by Clever Cloud.

6.5 Subprocessors

The following third-party services may process certain data:

  • Clever Cloud (hosting),
  • Stripe (payments),
  • In-app purchase services,
  • Google Maps / geolocation services.

6.6 Data Retention

Data are retained for 12 months from account deletion, unless otherwise required by law.

6.7 User Rights

In accordance with the GDPR, the User has the following rights:

  • access,
  • rectification,
  • deletion,
  • objection,
  • data portability,
  • restriction of processing.

To exercise these rights, the User may contact the DPO:

7. Geolocation Data

Geolocation is collected only during active use of the application, for the purpose of optimizing routes and travel.

The User may withdraw authorization at any time in their device settings, but certain features may become unavailable.

8. Cookies

The website uses:

  • technical cookies required for operation,
  • audience measurement cookies (including Google Analytics).

No advertising cookies are used.

The User may configure their browser to refuse cookies, but certain features may not function properly.

9. Intellectual Property

The following are protected by intellectual property law:

  • the Tournée facile trademark (registered with the INPI),
  • the logo,
  • the application architecture,
  • texts, images, interfaces, features,
  • the structure and source code of the software.

Any unauthorized reproduction, copying, or extraction is prohibited.

10. Liability

10.1 Publisher's Liability

The Publisher is not liable for:

  • errors related to routes, itineraries, or geolocation,
  • temporary unavailability of the service,
  • loss or alteration of data,
  • improper use of the service,
  • any damage resulting from inaccurate data or data entered by the User.

The application provides logistical information only, and no medical decision should be based on the information provided.

10.2 User’s Liability

The User is responsible for:

  • the accuracy of the data they enter,
  • compliance with medical confidentiality,
  • their professional decisions,
  • proper use of health documents.

11. Conditions of Use

Use of Tournée facile is restricted to:

  • healthcare professionals,
  • aged 18 or older.

Strictly prohibited uses include:

  • unauthorized commercial use,
  • large-scale data extraction,
  • reverse engineering,
  • any illegal or fraudulent use.

12. Financial Terms

Tournée facile offers:

  • a Freemium model,
  • a subscription with automatic renewal,
  • a free trial period,
  • refund conditions described on the subscription page.

In-app purchases are not offered (except subscriptions via app stores).

13. Modification of the Terms

The Publisher may modify the Terms at any time.

Users will be informed via the display of the new Terms on the website. Continued use of the service constitutes acceptance of the new provisions.

14. Applicable Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, and after attempting amicable resolution, the competent courts shall be those of Paris.
